Why would I conduct a trademark search?
A trademark search seeks to determine if there is a conflict with another's trademark. The search is performed without taking any unnecessary action that may place any prior trademark owner on notice of an infringement problem. A search also helps avoid filing a trademark application that will not issue. Whether to conduct a trademark search is a business decision that should be based on the uniqueness of the trademark and whether the trademark will actually be in use within 9 months of filing the application.
A search of the federal trademark records can be conducted relatively quickly. A more extensive search of federal, state and common law trademarks can be conducted in days. Please note, however, that no trademark search can be totally complete.
